Derecho a la información: transparencia , Ombudsman & Lobby

Rodrigo González Fernández de consultajuridicachile, señaló ante un grupo de funcionarios del Estado ,que el derecho a la información  - que duda cabe - es un derecho constitucional y al mismo un derecho humano. Ustedes son responsables de que Chile se haya visto sometido a Corte Internacional y se le ha condenado por no entregar información. Esto no es un caso aislado en la administración del estado y que falta hace un Defensor del Pueblo. Esperamos que nuestro Congreso se apure en la dictación de esta y otras leyes que hacen a la información y a a la transparencia como es también la ley de Lobby.  Estos institutos no pueden estar ausente en una democracia moderna.

Comisión de Gobierno aprobó la iniciativa, que ahora será vista por la de Constitución antes de ser votada por la Sala.

Tras un exhaustivo análisis y después de estudiar más de 250 indicaciones, la comisión de Gobierno del Senado aprobó y despachó el proyecto, en segundo trámite, que reconoce y regula legalmente el lobby o gestión de intereses en nuestro país.

Ahora corresponde que la iniciativa, que busca transparentar y regula dicha actividad, sea estudiada por la comisión de Constitución antes de ser sometida a la votación de la Sala.

Consultado sobre los efectos que tendrá la nueva normativa en la legislación chilena, el senador Pérez señaló que “indudablemente todo lo que es lobby es nuevo en el quehacer de nuestra sociedad y creo que esto es un buen punto de partida. Necesariamente la aplicación de la ley nos permitirá ver como funciona, pero creo que hemos avanzado positivamente y como punto de partida me parece oportuno”.

El parlamentario recordó que entre los cambios sustantivos que se le introdujeron al proyecto durante su tramitación en la Comisión, destaca haber establecido una sola categoría de lobbysta y no dos, como lo señalaba la iniciativa original.

“Nosotros consideramos que debe haber un solo tipo de lobbysta que es quien ejerce la actividad de manera remunerada. Hemos dicho que cuando viene la Sofofa o la CUT todo el mundo sabe a qué vienen y qué intereses vienen a defender. Lo que hay que regular es cuando vienen profesionales o empresas a influir por terceros y no existe conocimiento. Ese lobby hay que regular y lo demás es derecho a petición”, advirtió el legislador.

Inhabilidades y sanciones

Asimismo, destacó el hecho que se haya establecido la inhabilidad para que los parlamentarios y autoridades de Gobierno y del Poder Judicial no puedan ejercer lobby mientras estén en sus cargos y hasta un año después de haberlos abandonado.

"Creo que eso es un hecho relevante, puesto que la práctica nos indica que son personas que han tenido cargos de alta figuración pública. La inhabilidad es extensiva para las autoridades locales, pero sólo mientras estén en el ejercicio de sus cargos. Son los altos cargos de la administración del Estado, del Poder Judicial y del Congreso Nacional donde se establece la extensión de un año más de inhabilidad", explicó.

Además, la iniciativa establece una serie de sanciones y multas para quienes vulneren la ley, las que contemplan la suspensión o eliminación del registro de lobbystas y multas que fluctúan entre las 50 y 100 UTM, es decir, entre $1.615.000 y $3.230.000, aproximadamente.

“Las sanciones van desde la amonestación hasta la cancelación del registro y se estableció que a través de los reglamentos respectivos se dictamine cuando ocurre eso. Una persona que ha sido suspendida del registro puede ser rehabilitada y eso lo tendrá que establecer cada Poder del Estado”, dijo el senador Pérez.

El proyecto también contempla la creación de registros de lobbystas que deben ser públicos y además, un registro de audiencia, “por lo que cuando se pida una reunión, el lobbysta tiene que hacer una presentación por escrito y esa solicitud de audiencia va a tener que ser pública como también los antecedentes que presenta en la reunión y el acta que se levante de cada una de ellas”, advirtió el parlamentario.

Avance importante

Por su parte, el senador Ricardo Núñez (PS) señaló que “después de tanto tiempo de procesamiento legislativo de la ley de lobby creo que hemos sacado un proyecto bastante decente y que, en mi opinión, va a regular adecuadamente esta actividad que en nuestro país se realiza pero sin normas claras”.

Si bien manifestó que el proyecto puede ser “discutible” en términos de la efectividad de su aplicación dijo que confía en que “esto va a ser un adelanto en el proceso por el cual instituciones o personas influyen en terceros para que decidan de determinada manera”.

En tal sentido agregó que “este es un proyecto que pone sentido ético y jurídico a una actividad que hasta el momento en Chile no había estado reglada. Es un paso adelante en el proceso de modernización del Estado, porque todas las autoridades públicas quedan afectos a esta ley en la medida en que tengan alguna posibilidad de ejercer la tarea de tomar decisiones con la utilización de recursos propios del Estado”.

Asimismo, el senador Núñez destacó la importancia de que se establezca la obligación de registrar adecuadamente las reuniones que se realicen entre lobbystas y los sujetos pasivos de lobby.

No obstante, lamentó que el proyecto no haya sido derivado directamente a la sala, pues a su juicio “esto va a significar que no lo vamos a poder tener el 2006 como ley, sino que recién el próximo año vamos a estar en condiciones de promulgarlo”, puntualizó.

El 87 por ciento de la plata del Plan Colombia se ha quedado en empresas de Estados Unidos

La nueva mayoría política en el Congreso de Estados Unidos necesariamente revisará el Plan Colombia. No importa que el programa se haya iniciado en la administración demócrata de Bill Clinton, las metas que los gobiernos de Colombia y Estados Unidos se pusieron al comienzo del plan no se han cumplido. La mayor ayuda exterior de Estados Unidos, después del Oriente Medio, no está dando resultados.

En el año 2000, Pastrana y Clinton prometieron que el plan reduciría al 50 por ciento el tráfico de drogas de Colombia hacia Estados Unidos. Para evaluarlo acordaron que este año, 2006, la extensión de los cultivos de coca en Colombia tendría que haberse reducido a la mitad. También dijeron que transcurridos cinco años, es decir ahora, la cocaína en las calles de Estados Unidos sería tan escasa que el precio del gramo se habría duplicado.

Sin embargo, nada de eso ha pasado. El área total cultivada con coca tiene un tamaño muy similar al que tenía antes del Plan Colombia. A pesar de que el gobierno colombiano ha fumigado 100.000 hectáreas -siguiendo estrictamente la cartilla norteamericana-, la coca no se ha acabado. Simplemente se movió.

Los cultivos de coca, curiosamente, se vienen desplazando de las áreas con influencia guerrillera a las zonas con predominio paramilitar, o de bandas emergentes, como quieren llamarlas ahora. La coca acerca a los puertos y a los centros urbanos. El período de mayor crecimiento de los cultivos ilícitos coincide con la desmovilización de los supuestos 30.000 paramilitares.

El precio de la cocaína en las calles de Estados Unidos tampoco se ha reducido como lo vaticinaba el Plan. Un gramo que costaba 135 dólares en 1999, cuatro años más tarde había bajado a 106.

Estos resultados ya hacen bien difícil la defensa del Plan Colombia. Sobre todo ante un Congreso que se prepara para escrutar con lupa toda las gestiones de la administración Bush. Pero hay algo más grave.

Después de los ataques del 11 de septiembre, las prioridades del gobierno estadounidense cambiaron de la guerra contra las drogas a la guerra contra el terror. El presidente Pastrana y su embajador Luis Alberto Moreno entendieron que era el momento de moverse rápido para conservar la ayuda. Decidieron, entonces, presentar el Plan Colombia como la expresión local de la guerra de Bush contra el terrorismo.

Justamente esa guerra global -a la que voluntariamente nos amarramos- fue la causante de la derrota electoral republicana.

Por eso, no serán los argumentos colombianos los que puedan salvar al Plan Colombia. El único lobby efectivo será el de sus beneficiarios norteamericanos.

El 87 por ciento de la plata del Plan se ha quedado en empresas de Estados Unidos. DynCorp, que contrata pilotos para fumigar; Sikorsky, que fabrica los helicópteros Black Hawk; Monsanto, que vende los herbicidas; Lockheed Martin, que monta los radares, y otros más. Varios de estos conglomerados son al mismo tiempo los mayores contratistas en la guerra de Irak.

Estas empresas son tan republicanas, como demócratas. Tienen amigos en todas partes. Su lobby es infalible. Ganan todas las guerras. Se quedan con la plata de los contribuyentes de aquí y de allá, y nunca pierden las elecciones.

LOS SORPRENDIDOS. Ahora resulta que nadie conocía al senador Álvaro García Romero. Ni el primer primo, Mario Uribe, quien cariñosamente acogió la votación del gordo en su partido. Ni el presidente Uribe a quien jamás le ha molestado el apoyo de Eric Morris o de García Romero, ahora prófugo de la justicia y antiguo coordinador en Sucre del referendo "contra la corrupción y la politiquería".

Nada ha dicho el ministro de Defensa Juan Manuel Santos sobre Jairo Merlano, a quien él incluyó en las listas del partido de La U. Ni dirá nada el ministro del Interior Carlos Holguín que no se dejó sacar a Muriel Benito de sus toldas.

A ellos los toma por sorpresa lo que empieza a pasar. En cambio, pocos colombianos se asombran de que todos los políticos relacionados con el paramilitarismo (es decir con el narcotráfico) sean uribistas.

violencia de género para avanzar más rápido CËRDOBA, 10 (EUROPA PRESS) La ministra de Cultura, Carmen Calvo, que asistió hoy en Córdoba a la inauguración del XIV Feminario que organiza la Plataforma Andaluza de Apoyo al Lobby Europeo de Mujeres, afirmó que en la lucha contra la violencia a las mujeres "es un asunto en el que tienen que tomar el timón los varones porque mientras no sea así no avanzaremos más rápido".
En declaraciones a los periodistas, la ministra señaló que "hace falta que en los foros de este tipo participen los hombres" y afirmó que "no es posible que la sociedad avance sin la consideración, la energía, las esperanzas, libertades y los derechos de las mujeres".
De este modo, lamentó que "no seamos capaces entre todos, en una sociedad moderna como la nuestra, de atajar la violencia contra las mujeres", un asunto que, según dijo, es "absolutamente gravísimo del conjunto de la sociedad, de la seguridad física en las propias mujeres y del modelo de convivencia en el que nos estamos moviendo".
Asimismo, manifestó que "muchos de los peligros que corre el mundo no existirían si las mujeres llevaran mucho más tiempo en el siglo XX participando en las decisiones y estrategias de la gobernanza".
Por su parte, la alcaldesa de Córdoba, Rosa Aguilar, que también acudió a la inauguración, destacó que "la democracia todavía es incompleta porque no hay una igualdad real aunque las leyes lo proclamen en la vida diaria de los ciudadanos, sino que aún se pone de manifiesto esa desigualdad en el campo educativo, en el ámbito de la pobreza, en el campo de la inserción laboral y con un tema que pone en evidencia el conjunto de la sociedad que es la violencia de género".
Por eso, apostó por que las mujeres "sigan comprometidas caminando, dialogando, encontrándonos, debatiendo y buscando las mejores respuestas y por eso tenemos también que hacer un llamamiento al conjunto de la ciudadanía para que los hombres, cada vez más, se sumen en esta causa común que debe ser la igualdad plena para toda la sociedad en términos de oportunidades, de derecho y en términos de construir entre todos una democracia completa".

La ministra de Cultura, Carmen Calvo, aseguró ayer que "el machismo solo es otra forma de fascismo", e instó a los varones a "tomar el timón" en la lucha contra la violencia de género, "porque es un asunto que les atañe a ellos más que a las mujeres, que son las víctimas", al tiempo que aseguró que "no avanzamos más para erradicar esa violencia porque no hay conciencia ni autoconciencia".

Calvo hizo estas declaraciones en la inauguración del XIV Feminario que organiza la Plataforma Andaluza en Apoyo al Lobby Europeo de Mujeres, que este año tiene por lema una pregunta ¿Existen las democracias sin la ciudadanía de las mujeres? y en el que participan unas 300 mujeres. La ministra comparó la violencia de género con otras lacras como el apartheid, "que no acabó hasta que los blancos sudafricanos se dieron cuenta de que no se podía hablar de democracia sin los derechos de los negros".

MAS SUBVERSIVAS Carmen Calvo comentó que "cuando hablamos de democracia paritaria, desde el neoconservadurismo se piensa que es algo artificial, pero lo único que hacemos es subir el siguiente escalón de la democracia, para lo que hay que incorporar la historia y la experiencia de las mujeres". En este sentido, la ministra se dirigió a las mujeres y dijo que "tenemos que ser mucho más subversivas, más peligrosas, porque seguimos sin tener la suficiente influencia para colocar en las agendas políticas la igualdad real y los temas que nos preocupan".

La ministra y diputada cordobesa también se refirió a la prostitución y la explotación sexual, otro de los temas que se tratarán en el feminario, y comentó que "a quienes digan que eso es una profesión les diría que llevaran a sus hijas a la escuela de prostitución. Nadie lo haría, claro, porque es una forma de esclavitud, no un oficio".

A la inauguración del acto también asistieron la alcaldesa de Córdoba, Rosa Aguilar; la directora general de Servicios Sociales, Purificación Causapié; la delegada de Igualdad de la Diputación, María Dolores Villatoro, y la presidenta de la Plataforma Andaluza del Lobby Europeo de Mujeres, Rafaela Pastor.

"MUJERES INTERCAMBIABLES" La alcaldesa aseguró que "la democracia que vivimos está incompleta porque no hay una igualdad real, aunque las leyes la proclamen" y destacó las desigualdades en el ámbito laboral, educativo, doméstico, de poder, y también la violencia de género. Rosa Aguilar hizo un llamamiento a los hombres "para que se sumen a esta causa común que es la igualdad plena de oportunidades y derechos para todos".

En su intervención, Aguilar destacó que "cada vez hay más mujeres que acceden a cargos públicos, pero permanecen menos tiempo", ya que, según comentó, "cuando se diseñan las listas electorales parece que los hombres siempre son imprescindibles y las mujeres intercambiables, por lo que se establece una competencia entre nosotras". Por ello, Aguilar considera que todas las mujeres políticas, sean del partido que sean, "deberíamos ser más cómplices y diseñar una agenda común de mínimos sobre los temas de igualdad".

María Dolores Villatoro recordó que, aunque se ha avanzado mucho en el reparto igualitario del poder, con gobiernos paritarios tanto a nivel central como autonómico, la asignatura pendiente sigue siendo el poder local, donde "solo un tercio de los concejales somos mujeres y las alcaldesas suponen apenas el 13% de los regidores".

Purificación Causapié también se refirió a las desigualdades en distintos ámbitos y recordó que, según un reciente estudio del Instituto de Estadística de Andalucía (IEA), "las mujeres dedican una media de cinco horas al trabajo doméstico y los hombres dos, pero esos datos tienen trampa porque el 95% de las mujeres le dedican tiempo a la casa, mientras que solo el 60% de los varones reconocen hacerlo".

Por su parte, Rafaela Pastor, señaló que "tenemos que hacer un feminismo político, y mientras haya una sola mujer prostituida, explotada, debemos luchar desde la política". También destacó que "ya es hora de que exijamos el laicismo, porque todas las iglesias nos han esclavizado".
